Terms & conditions of Sale
(1) Introduction
Please read these terms of sale carefully.
You the customer agree to these terms of sale by purchasing or placing an order for whole or part of our product range.
(2) Interpretation
In these terms of sale or order, "we" means Buffalo Leather Repair And Care Ltd (and "us" and "our" will be construed accordingly); and "you" means our customer or potential customer for products.
(3) Order process
Your order or purchase of products constitutes a contractual offer. No contract will come into force between you and we unless and until we accept your order in accordance with the procedure detailed below.
In order to enter into a contract to purchase products from us, you will need to take the following steps:
a) Be sure of your leather type as certain products may not be suitable for certain types of leather
b) Before purchasing products determine that you do not have a leather problem, Buffalo products improve or maintain the appearance of leather, they do not solve problems that originate from the tannery, manufacturing or shipping process, or problems that human skin secretion can cause.
c) Determine your leather colour, we cannot replicate accurate leather colours on our website due to your computer screen resolution, we accept leather samples posted to our workshop for colour selection or matching, we cannot guarantee a 100% accuracy for reasons stated within our offered range of stocked pigments.
d) A technician is available to advise on product selection, but this advice should not be represented as confirmation of actual products required by you the customer.
(4) The products
The information provided herein is correct to the best of our knowledge. No warranty is expressed or implied as the conditions of use by you the customer are beyond our control. For health & safety information please contact us.
Buffalo products are not to be taken internally or placed in the eye or mouth area, seek medical attention should this occur.
Buffalo will not be held responsible for any reactions to the skin or breathing difficulties, precautionary measures must be taken by you the customer to prevent these reactions, such as suitable protective breathing apparatus & room ventilation, and protective skin coverings.
Prior to purchase of products from us, you will need to take the following steps:
a) We cannot be held responsible for inaccurate product choice; we have guides available & back up advice from a leather technician. Advise & guides cannot be confirmation of your leather type, colour, problem or otherwise as a site visit must be given at the consumers abode, workplace or otherwise to give conformational information before product selection or to advise against product selection.
b) Buffalo Leather repair & care products are intended to improve or maintain the appearance of damaged, worn, new or aged leather surfaces. The application of products is dependent on the skill of the user & we cannot guarantee your skill of application to achieve the desired effect you require. We cannot be held responsible for the misuse or incorrect application of repair & care products. We cannot guarantee the longevity of the repair & care products once applied to the leather surface, as this is dependent on the care routine, ongoing maintenance of the leather, problems that may occur from within or on the leather caused by the tannery, manufacturing or shipping process, problems that human skin secretion can cause, and abuse the leather surface may receive from humans & animals or otherwise.
c) We do not accept returns or exchange for products made specifically for your requirements such as colour match products or tinted dye sealants.
4a) Colour Matching Service
We can only match water based pigments to the surface of plain solid coloured leather samples provided. The sample provided may differ considerably to the aged surface to be restored, therefore the colour match may require you to make adjustments to match the aged worn surfaces. We cannot provide exact colour matches to to two tone leather colours as these surfaces tend to have varied colour over the whole furniture item - The sample may vary greatly in colour to that on the actual surface.
(5) Price and payment
Our price list contains a large number of products and it is always possible that some of the prices may be incorrect. We will verify prices as part of our sale procedures so that a product's correct price will be stated when you order or pay for the product.
In addition to the price of the products there is a delivery charge, which will be as stated when you order or pay for the product.
Payment must be made upon the submission of your order. We may withhold the products and/or cancel the contract between us if the price is not received from you in full in cleared funds.
The prices exclude all value added taxes and carriage charges.
Payment for all products may be made by online secure credit card facilities or by PayPal. Cheque made payable to Buffalo Leather Repair and Care Ltd, 3 days bank clearance on all cheques are required by Buffalo Leather before goods are dispatched. Payments can also be processed over the telephone by debit/credit cards by contacting: 01772 611449. Prices for products are liable to change at any time, but changes will not affect contracts which have come into force.
(6) Your warranties
You warrant to us that:
(a) You are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale;
(b) The information provided in your order is accurate and complete;
(c) You will be able to accept delivery of the products;
Please note we do not accept international purchases or otherwise outside the UK mainland.
(7) Delivery policy
The following delivery information will help you to understand our terms & conditions of sale:
Buffalo does not charge a profit on postal & packaging charges and remain fair regarding these delivery costs.
(8) Statutory rights
Nothing in these terms of sale affects your statutory rights (including your right to receive a refund in respect of any defective product we sell to you).
(9) Refunds
If you cancel a contract and are entitled to a refund, we will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event, within 30 days of the day we received your valid notice of cancellation.
We do not issue refunds for used products.
We do not issue refunds or exchange of products for colour match or tinted sealant products which are formulated to your specifications.
We do not refund or exchange items whereas you the customer may change your mind regarding your purchase after the 14 day cooling off period of 14 days.
(10) Limitations of liability
Nothing in these terms of sale will limit or exclude your or our liability for: (1) death or personal injury caused by negligence; (2) fraud or fraudulent misrepresentation; or (3) any matter for which it would be illegal to limit or exclude, or attempt to limit or exclude, liability.
Subject to this, the products we sell are intended for you the customers use only and we will not be liable for any business losses (including without limitation loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data or waste of management or office time).
If you the customer takes the decision to re-sell or offer our products using our brand or label, your own brand or label, or otherwise, the liability of the product passes to you 'the customer'
(11) General terms
Images of products on our website are for illustrative purposes; actual products may differ from such images.
You may not assign charge, sub-contract or otherwise transfer any of your rights or obligations arising under these terms of sale. Any attempt by you to do so will be null and void. We may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising under these terms of sale, at any time - providing such action does not serve to reduce the guarantees benefiting you under these terms of sale.
Each contract under these terms of sale is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The right of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.
Subject to the first paragraph of Section [1]: these terms of sale contain the entire agreement and understanding of the parties in relation to the purchase of products and supersede all previous agreements and understandings between the parties in relation to the purchase of products and each party acknowledges that no representations not expressly contained in these terms of sale have been made by or on behalf of the other party in relation to the purchase of products.
These terms of sale will be governed by and construed in accordance with English law, and the courts of England and Wales will have non-exclusive jurisdiction to adjudicate any dispute arising under or in relation to these terms of sale.
